Text for Amendments

These short texts are designed to help with the wording for amendments or other negotiations. You should always check with your broker before incorporating these words into any final document to be sent to either party.


Asbestos (Removal)

The vendor agrees, on or before closing, at his/her expense, to have all the asbestos in the subject property professionally removed, using licensed contractors.
The vendor further agrees to provide air quality test results, before and after the removal and to provide all receipts and guarantees from the licensed contractor.

 

Asbestos (Testing)

The vendor agrees, at his/her expense to have the material found in the ………………………. (identify location), professionally tested at a recognized and licensed laboratory on or before ……………… (date). (Note: Typically three business days is enough.).
The vendor further agrees to provide the purchaser with a copy of the laboratory results immediately upon receipt.

 

Furnace defect.

The vendor agrees, at his/her expense, on or before closing, to have the defective ……………………………….. (explain defect) replaced, using new parts to be installed by a professional, licensed technician. The vendor further agrees to provide all relevant documentation and guarantees including receipts for the work and all instruction and installation manuals, at closing.

 

Furnace failure (complete) (red tagged by governing authority).

The vendor agrees, at his/her expense, on or before closing, to have a new mid/high efficiency gas/oil furnace installed at the subject property.
The vendor further agrees to use professionally qualified personnel and to have the unit installed in accordance with all current construction, gas or related codes and in accordance with the manufacturer’s instructions.
The vendor further agrees to provide all relevant documentation and guarantees including receipts for the work and all instruction and installation manuals, at closing. Any units installed in relation to this amendment, must be of an appropriate size for the subject property as shown in the required heat loss survey, and must be in working order on closing.

At the sole discretion of the purchaser, any or all repairs or replacements carried out by the vendor in accordance with this amendment, are subject to re-inspection by the purchaser’s building inspector. The vendor agrees to allow such an inspection at any reasonable time (by appointment) on or before closing.

 

Oil storage tank replacement due to failure – or one that is too old.

The vendor agrees, on or before closing, at his/her expense to replace the oil storage tank in the subject property with a new tank of the same size and quality and to have the old tank removed from the premises. 
The vendor further agrees that the replacement of any ancillary piping or related equipment, needed to complete the installation will also be at his/her expense.
The disposal of the old tank must be in accordance with all current environmental and related legislation.
The vendor further agrees to use only professionally qualified personnel and to provide all receipts, guarantees and other relevant documentation on or before closing.

At the sole discretion of the purchaser, any or all repairs or replacements carried out by the vendor in accordance with this amendment, are subject to re-inspection by the purchaser’s building inspector. The vendor agrees to allow such an inspection at any reasonable time (by appointment) on or before closing.

Repair a crack in a foundation wall.

The vendor agrees, on or before closing, at his/her expense, to have the crack in the …………………… (describe the location) wall professionally repaired by a qualified contractor using new materials and in accordance with current building codes (where applicable) and good building practice.
The vendor further agrees that the contractor will provide a written guarantee against leakage for the benefit of the purchaser, for a minimum period of five(ten) years.
The vendor agrees to provide the written guarantee, receipts and all relevant documentation, on or before closing.

At the sole discretion of the purchaser, any or all repairs or replacements carried out by the vendor in accordance with this amendment, are subject to re-inspection by the purchaser’s building inspector. The vendor agrees to allow such an inspection at any reasonable time (by appointment) on or before closing.
